The seven man panel of judges that sat to rule on the case today in Abuja, passed the judgement after reviewing and cross-examining the appeal brought forward by Timipreye Sylva, the candidate of the All progressives congress (APC) in the last bayelsa elections. 
 
The court of appeal and Election Tribunal had earlier canceled Dickson's emergence as governor until today.</div>

The Tribunal Chairman, Justice Kazeem Alogba, gave the date on Thursday after taking arguments from parties in the petition challenging the election and declaration of Chief Seriake Dickson as governor of Bayelsa State. 
In the motion on notice filed and argued by Sebastine Hon on behalf of the petitioner, an order of the Tribunal was sought to compel the chairman of the Independent National Electoral Commission to allow the petitioner inspect election materials used for the poll. 
Among the 37 materials sought to be inspected are the ballot papers used, thumb printed and counted as valid, the ballot papers recorded as spoilt, un-used and print out of records of accreditation as captured by the Smart Card Reader. 
Others are the voter register in all the polling units and the eight Local Government Areas, INEC result sheets, security report on the election, appointed observers’ reports, video and audio reports on the election and letters of complaints of irregularities and malpractices during the election addressed to INEC. 
Moving the motion, predicated on seven grounds, Hon prayed the Tribunal to grant the request since the electoral body, which conducted the election and is in possession of the items, did not oppose the application. 
Hon said in law, the facts deposed to in an affidavit and not challenged by way of counter affidavit are deemed admitted by the respondents by the force of law. 
The counsel argued that the counter affidavit filed by Dickson through his counsel, Tayo Oyetibo (SAN), was misconceived and misplaced because it did not address the issues raised in the petitioner’s motion. 
The petitioner’s lawyer argued that it was wrong of the governor (2nd Respondent) to have claimed that the petitioner’s motion was vague because the documents sought to be inspected by the petitioner are well pleaded in the petition and in line with section 151 of the Electoral Act 2010. 
However, in his opposition to the request, Dickson urged the Tribunal to refuse the application for lacking in merit. 
Oyetibo submitted that the prayers in the application of Silva did not support what he wanted to the Tribunal to do for him. 
The Governor’s counsel specifically insisted that the petitioner’s request was vague because it failed to mention the author or maker of the material sought to be inspected. 
Besides, Dickson’s counsel claimed that the petitioner failed to give reasons why he wanted to inspect the materials used for the election, adding also that the request violated section 104 of the Evidence Act because the mandatory fee for certification of the materials has not been paid by the petitioner. 
Oyetibo also submitted that his client has every right to oppose the inspection of the election materials by reason of fair hearing because the inspection, if carried out, can have direct negative consequences on the Governor, his client. 
He urged the dismissal of the application for lacking in merit. 
Alogba fixed April 11, 2016 to deliver ruling on whether to allow the inspection of the materials or not.</div>

According Sahara Reporters, this judgment was carried out by a high court in the Oporoma judicial division in Bayelsa state on Tuesday, March 22, after he was found guilty of killing one Inspector Joseph Ofozini. 
 
 
Feutubobai was among the killers of eleven policemen who were reportedly killed in the Lobia II community in the Southern Ijaw local government area of the state on April 5, 2013. 
 
The police prosecutor had informed the court of the accused’s five other cases in various courts, including cases involving an alleged kidnapping and sea piracy. 
 
After hearing the application against the suspect, the presiding Justice, M A Ayemieye sentenced Feutubobai to death by hanging, noting that it is mandatory for those accused of murder to be sentenced to death. 
 
Arthur Andrew Seweniowor, the state prosecuting counsel, who addressed journalists after the sentence, said if the accused fails to appeal in three months, the death warrant will be signed by the governor. 
 
Efieseimokumo Bipedei, who represented Feutubobai before the court, had earlier pleaded with the court to temper justice with mercy, arguing that the accused person is a family man with five children dependent on him, asking the court to reduce the sentence to imprisonment. 
 
ThankGod Clinton Ezetu, the second accused person was later discharged and acquitted after no evidence linked him to the murder of the eleven policemen.</div>

Mr. Samuel Oki, a nephew of former President Goodluck Jonathan, was today found dead in a creek in Otuoke community, Ogbia Local Government Area of Bayelsa State. 
 
The 35-year-old was reportedly kidnapped on Wednesday alongside the 72-year-old foster father of Jonathan, Chief Inengite Nitabai. 
 
It was learnt that some fishermen from the former President’s community in Otuoke, discovered Oki’s decomposing body floating on Otuoke river while fishing, two days after the abduction. 
 
 
 
Some indigenes of the community said though many were not aware of Oki’s whereabouts during the abduction of Nitabai, the discovery of his body in the creek has, however, heightened their fears of Nitabai’s safety. 
 
Some community members claimed that the sound of gunshot heard during the abduction of the septuagenarian might have been targeted at the deceased. 
 
A community source, who spoke on the condition of anonymity, said “We are worried about the safety of our uncle, Chief Inengite Nitabai. The men that abducted them have killed Oki and we pray they don’t touch our uncle.” 
 
The deceased, community sources said, was always seen in company with Nitabai. 
 
The villagers, who were reportedly seen discussing the sad incident, alleged that the young man (Oki) tried to resist the kidnappers. 
 
According to them, divers and local fishermen had recovered the body and anchored it by the riverside to prevent the body from being washed away. 
 
This is the second time Nitabai has been kidnapped. He was first kidnapped On February 28, 2014 and later freed by security forces on March 10, 2014.</div>

The Police Public Relations Officer, Bayelsa State Command, Mr. Asinim Butswat, gave the names of the suspects as Thurlbert Femi, 19, and Festus Fefegha, 18. 
 
Butswat said the Femi and Fefegha, armed with a locally made pistol, entered the boutique of one Sunday Anyigor and robbed him of assorted wears and other valuables. 
 
The police spokesman said the incident occurred at Okaka area of Yenagoa Local Government Area of the state on Wednesday. 
 
Bustwat said the suspects were unlucky when Anyigor and his wife, not deterred by the gun pointed at them, locked the shop and raised the alarm which attracted the neighbours. 
 
He said the neighbours in turn informed the police who swooped on the scene and got the suspects arrested. 
 
He said the suspects were already detained at a police station and that investigation was ongoing. 
 
A statement released by Butswat said, “On the February 3, 2016, at about 1920hrs, the duo of one Thurlbert Femi, male, 19 years and one Festus Fefegha, 18, armed with a locally-made pistol, entered the boutique of one Sunday Anyigor, at Okaka Street, Yenagoa. 
 
“The suspects selected assorted wears and other valuables and pointed the gun at the shopowner(Anyigor) and his wife. 
 
“Consequently, the shopowner bravely locked the robbers inside and alerted neighbours and the police. The robbers were arrested and the exhibits recovered. Investigation is ongoing.” 
 
Meanwhile, the State Police Command has said that normalcy has returned to Premabiri community in Southern Ijaw Local Government Area of the state following widespread violence that marred the recently concluded governorship poll. 
 
Butswat said security agencies in the state had unanimously condemned any form of banishment in any community. 
 
He said every Nigerian has the right to live anywhere in the country and to own immovable property within the country. 
 
He urged people who were displaced from their communities to return, noting that adequate security measures had been put in place to guarantee their safety.</div>
