President Buhari’s lead counsel, Wole Olanipekun (SAN), said the petition was by his client on April 16. Olanipekun said: “We filed our reply on 16th April 2019 and we also filed our motion including preliminary objections. We argued that the preliminary objection be set down for hearing during the pre-trial." In the objection, the president asked the court to dismiss Atiku’s claim that he lacked the qualification to be president on the grounds that by virtue of Section 31(5) and (6) of the Electoral Act, 2010 (as amended). He said: “It is the Federal High Court or of a State that has jurisdiction to adjudicate on the grounds/complaints contained therein.” The petition by President Buhari followed the suit was filed by Atiku against the victory of the All Progressives Congress (APC) at the 2019 presidential election. In her reaction, the president of the Court of Appeal, Justice Zainab Bulkachuwa warned against public comments which would publicly decide presidential petitions in the court and overheat the polity. Bulkachuwa said: "We therefore require the maximum cooperation of all the stakeholders, especially from the leaders of the Bar. We expect the proceedings to be conducted with decorum, a high sense of responsibility, dedication, and patriotism in our quest to arrive at just decisions in all petitions before us." Fayose made the remark, shortly after his counterpart from Bayelsa State, Seriake Dickson announced him as the new Chairman of the PDP governors’ forum, on Friday in Abuja. 
 
Speaking on his new role, Fayose said he accepted the responsibility to work as chairman of the Forum. 
 
The governor promised to work with stakeholders, including the National Assembly, to restore the glory of the PDP. 
 
According to Fayose, “I take this responsibility at a time the party needs somebody to stand up. I am sure you all know that we will do it to represent Nigerians well. 
 
“It is a call to pull the walls of Jericho down; it is a call to make a difference. 
 
“I want to assure you that within the next few months, the mobilisation, the consultation will be so effective and there will be a new beginning for our party – different and enriching. 
 
“I will take over from where he stopped. Come 2019, we will take over again; we are going to come back again.” 
 
Earlier, Dickson while making the announcement said, “As an integral part of the discussion, the governors of our party, among ourselves, as well as those who were unavoidably absent, unanimously appointed a new PDP Governors’ Forum Chairman. 
 
“In line with the tradition of our party, we agreed to appoint our colleague, the most senior governor in PDP, Ayodele Fayose, the governor of Ekiti as new Chairman of the PDP Governors’ Forum. 
 
“You are all aware that he is a committed party man, doing a wonderful job in his state. He is well experienced and committed to the ideals of our party. 
 
“We have all unanimously appointed him as the new Chairman of the PDP Governors’ Forum to coordinate the affairs and activities of our forum and to work and collaborate with other structures of our party,” Dickson said.</div>

According to the Nation, a statement issued by his Special Adviser on Media and Publicity, Femi Adesina, said the President spoke during a meeting with the governorship candidate of the All Progressives Congress (APC) in Ondo State, Rotimi Akeredolu, APC elders in the state, and national officers of the party before the commencement of the party governorship campaign rally in Akure, the state capital. 
 
President Buhari assured that his government would correct mistakes of past administrations. 
 
The statement said, 
 “Buhari assured Nigerians that determined, steadfast and patriotic people in the APC-led government will transform the nation’s ailing economy, which was run aground by the party that governed Nigeria for 16 years from 1999 to 2015.</div>

This was even as scores of people were injured, following a clash between supporters of the PDP and men of the state police command. 
Earlier in the day, APC supporters had staged a peaceful protest in Port Harcourt demanding the swearing in of two lawmakers elected on the party’s platform into the state House of Assembly. 
The two lawmakers are Victoria Nyeche representing Port Harcourt City 1 Constituency and Andrew Miller, representing Opobo/Nkoro Constituency. 
 
The APC protesters marched from the party’s secretariat along Forces Avenue, Old GRA, Port Harcourt, through major streets, with placards. 
The protesters were, however, stopped by policemen, who took over strategic government buildings in the state, especially the Government House, the House of Assembly complex and the High Court complex, from going beyond the Central Bank of Nigeria (CBN) area, to avert a clash with PDP supporters. 
 
Secretary of APC in the state, Chief Emeka Bekee, said they did not take their protest to the House of Assembly complex as initially planned because of the planned visit of Governor Nyesom Wike, to the House. 
“The governor had fixed a programme in the House of Assembly and because APC is a law-abiding party that has the fear of God, we want to give them the benefit of doubt. But, subsequently, we will not accept that. Whatever they want to happen will happen; we will not take it anymore,” Bekee said. 
 
However, Publicity Secretary of PDP in the state, Samuel Nwanosike, denied claims by the police that supporters of the party were out to counter the protest by members of the opposition APC. 
He insisted that they had mobilised to pay a solidarity visit to the Speaker, Adams Dabatorudima. 
“Funny enough, on our way to the Rivers State House of Assembly, we saw fierce looking Policemen, who attacked us with live ammunition and teargas. 
Some of our colleagues are in the hospital right now with life threatening injuries,” he claimed. 
He called on the Inspector General of Police (IGP) to investigate the attack on the unarmed youths.</div>

The visibly shaken Faleke disclosed this himself in a report he lodged at the Gwagwalada Police Division in Abuja. Police reports indicate the lawmaker was attacked between 7pm and 7.30pm on Sunday November 6. 
 
The bullets hit the front windshield of his bullet-proof vehicle thrice before the first bridge at Gwagwalada. 
 
In his words; 
 
I was returning from Kogi state on November 6 and my vehicle was shot at the first bridge in Gwagwalada, which is under construction between 7pm and 7.30pm. About three bullets hit my jeep, but thank God, it was a bulletproof car. The bullets cracked the windscreen but did not penetrate. I’m grateful to God for the life of my driver, orderly and myself. We reported the incident to the Police Division in Gwagwalada, FCT. 
 
Faleke was the running mate to the Kogi state All Progressives Congress (APC) governorship candidate in the November 21, 2015 election, the late Prince Abubakar Audu. He was set to become deputy governor of Kogi before Audu's unfortunate death.</div>

Falana spoke at a symposium tagged: “X-raying 50 years of military intervention in Nigeria’s politics”, organised by the Department of Political Science, University of Lagos. 
 
Falana urged the President to forget about the loan and begin aggressive recovery of the country’s looted funds stashed away in foreign countries. 
 
He said: 
 
“Between 1978 and 1986, this country incurred debts to the extent that we did not know how much we owed under the regime of General Ibrahim Babangida. They had to engage the services of a consultant in the West to tell us what we owed, and of course, the London Paris Club gave us a figure. That was the extent to which governance deteriorated. 
 
“By the time [former President Olusegun] Obasanjo was paying the debts, in one fell swoop in 2005, this country parted with $12.4bn for the West to forgive our debts. Meanwhile, they were the real sinners. At that time, on both the principal and the interest, we had paid $42bn. That amount alone could have eradicated poverty in the entire Africa. 
 
“Now again, President Buhari wants to get a loan of $30bn. You know what that means? For generations unborn, we will mortgage their future, except the money is genuinely meant for infrastructural development, which is usually not the case once the money comes in. So Buhari should forget about the $30bn loan when he can get more than that if he goes after our stolen money in the West.”</div>

The Commission subsequently went ahead and published Mr. Jegede's name as the Candidate of the ruling party despite a factional crisis rocking the State Peoples Democratic Party (PDP). 
 
The electoral body, however, dropped the name of Jimoh Ibrahim who has also been parading himself as the recognized governorship Candidate of the PDP in the same state. 
 
Mr. Ibrahim, a controversial businessman was the factional candidate of the party under the control of the embattled factional PDP Chairman, Alimodu Sheriff. 
 
Mr. Jegede, a former Attorney General and Commissioner for Justice in Ondo State was the factional candidate of the PDP in the state under the factional National Chairman, Ahmed Makarafi. 
 
The duo of Biyi Poroye and Clement Faboyede laying claims to the leadership control of the Peoples Democratic Party in Ondo State. 
 
SaharaReporters correspondent reported that the Commission has also recognized Rotimi Akeredolu as the gubernatorial candidate of the opposition All Progressives Congress in Ondo State. 
 
It was learned that the Commission had already cleared no fewer than twenty-eight political parties and their Candidates that would participate in the November 26th governorship poll in the state. 
 
Names of the political parties and their candidates where made public on Thursday evening.

In a statement by the Special Adviser on Media and Publicity, Femi Adesina, the President said that the outcome of the election clearly reflected the mood of the people to sustain the pedigree of responsiveness, forthrightness and diligence that Governor Oshomole brought into the service of his people. 
‘‘The victory is good for democracy, for Nigeria and the people of Edo State,’’ he said. 
President Buhari also said that the victory was well-deserved as the campaign train, which he joined, worked hard to sell its people-centered manifesto.He applauded the conduct of the Independent National Electoral Commission, security agencies, corps members and electorate in ensuring a peaceful election.INEC had announced that Obaseki won the majority of the votes cast, with a total of 319,483 votes, and he was closely followed by Pastor Osagie Ize-Iyamu of the PDP, who polled 253,173 votes.

Ojezua, who said the entire process of the election had been nothing but peaceful, said it was “a pity that PDP expected to win in a state that it had run down”. 
 
“This is just a case of a bad loser. It is a pity that the PDP expects to win in a state which it had run down,” he told reporters in Benin. 
 
“Though the announcement of the results is still ongoing, I commend INEC thus far. The process was very peaceful. INEC was efficient in delivery of materials to ensure that they got to locations on time.” 
 
He advised the PDP to channel its grievances to the appropriate quarters. 
 
The PDP had earlier announced the rejection of the results of the election, describing it as “fabricated and pre-determined”.</div>

 The DMO figures had ranked Edo State as the third most indebted state in the country in terms of  sub-national foreign debts with a total of $179.52million, with the governorship candidate of the PDP, Pastor Osagie‎ Ize-Iyamu, saying that his position that Edo was one of the most indebted states, has been vindicated. 
 But in a statement in Benin City on 23rd Friday, the state Commissioner for Information and Orientation, Prince Kassim Afegbua, noted that: “following the declaration by the Debt Management Office that Edo state’s foreign debt profile ranks third among indebted states in the country, the Peoples Democratic Party that plunged Edo state into huge debts has been upbeat, saying they have been vindicated. How wrong? We do not only find PDP’s assertion ridiculous but utterly uninformed.” 
“First, Edo state was categorised as one of the wealthiest states in the country following our holistic reforms in the area of Internally Generated Revenue, which saw a huge improvement in our Internally Generated Revenue portfolio. 
“Secondly, we do not borrow funds to pay salaries like PDP state Governors, especially in the South-South geo-political zone. Our loans are tied to specific infrastructural development projects aimed at improving the lives of our people. Unlike in the past during the era of the PDP when loans were sourced and shared amongst party chieftains, the present thinking has altered the ugly narrative of pocketing loans; we have built infrastructure in critical sectors of the Edo economy. 
“A critical look at the three top states of Lagos, Kaduna and Edo would readily reveal the huge infrastructural developments in those three states. While it has been difficult for PDP states to attract World Bank loans because of the rigorous screening it entails, PDP states in the South-South have been taking loans from Commercial Banks with neck-breaking interest rates. Our foreign loans attract 1% interest rate with a 10-year moratorium. The representatives of the World Bank are not only proud of Edo state for utilising her loans diligently; they have commended the Comrade Governor at different times for applying probity and accountability in the management of Edo resources. 
“Through such fiscal assistance from World Bank, we were able to address the Queen Ede erosion menace, Auchi erosion and the Ekenhuan erosion menaces. We have built infrastructure across the length and breadth of the state and are proud to say that our records of performance would remain indelible in the minds of present and future generations of Edo people. 
“We are not like the PDP that took loans during their ten years reign and shared amongst their party chieftains. 
They sucked Edo people to the point that it took the intervention of God and man to get the state back on track. We are certainly not reckless financial suckers like the PDP. We are proud to say that we have applied our loans for the purpose they were meant. It will interest PDP chieftains to note that under the Oshiomhole administration, we have repaid billions of naira loans acquired during the inglorious years of the PDP”, the statement said.

Nick Dazang, the Independent National Electoral Commission (INEC), Deputy Director for Voter Education and Publicity, disclosed this in an interview with NAN on Tuesday in Abuja. 
Mr. Dazang said the decision to accept Mr. Ize-Iyamu, candidate of the PDP National Caretaker Committee, led by Ahmed Makarfi, was informed by the court’s decision on the matter. 
“The commission collected the nomination from Makarfi-led faction because he has a court judgment that says INEC should accept his candidate. 
“Secondly, you will recall that it is only his own faction of PDP primary that the commission monitored,” Mr. Dazang said. 
The PDP has been rocked by an internal crisis, with two factions laying claim to the party’s national leadership. 
A faction led by Ali Modu Sheriff submitted the name of Matthew Iduoriyekwemwen as its candidate for the Sept. 10 Edo polls, after the Makarfi faction had submitted Mr. Ize-Iyamu’s name. 
The Makarfi’s group, supported by all organs of the party, including the Governors’ Forum and the Board of Trustees, conducted its primary on June 20 in Benin and elected Mr. Ize-Iyamu as candidate. 
On June 29, at another primary that was not supervised by INEC as required by the Electoral Act, Mr. Sheriff’s faction picked Mr. Iduoriyekwemwen as the party’s candidate for the Sept. 10 election. 
INEC had said earlier that it would not accept any candidate until a court decides on the matter. 
A Federal High Court in Port Harcourt on July 4 held that the May 21 national convention that removed Mr. Sheriff as chairman and constituted the National Caretaker Committee was duly constituted. 
The court also declared that the dissolution of the National Working Committee and the National Executive Committee by that convention was valid. 
In the judgment, Justice Abdullahi Liman declared that the appointment of the caretaker committee to oversee the party’s affairs was legal and in line with the provisions of PDP Constitution. 
Mr. Dazang said on Tuesday that the commission had received nomination forms from 19 political parties including the All Progressives Congress (APC). 
He listed others as: Action Aliance (AA), African Democratic Congress (ACD), Advance Congress of Democrats (ACD), Allied Congress Party of Nigeria (ACPN), All Progressives Grand Alliance (APGA), Citizens Popular Party (CPP), Independent Democrats (ID) among others.

At the Federal High Court, Ado-Ekiti, Fayose challenged the legality of EFCC freezing his accounts. His lawyer, Mike Ozekhome has already filed a suit on the matter. 
 
On July 4, EFCC filed an affidavit at the court leading to an adjournment of the case as requested by Ozekhome to enable him time to address the allegations. 
While the APC, joined by Conference of Nigerian Political Parties (CNPP) and other anti-Fayose groups trooped to the streets of Ado Ekiti to protest alleged looting of the state’s commonwealth by Governor Fayose, challenging the governor to waive his immunity and submit himself for probe, the governor’s aide, Idowu Adelusi, dismissed their allegations as spurious . 
Adelusi said asking the governor to waive his immunity amounts to “ranting of an ignorant lot.” 
Describing the freezing of Fayose’s accounts by the EFCC for allegedly containing N1.3 billion slush fund from the office of the former National Security Adviser (NSA), Col. Sambo Dasuki (retd), to fund the governor’s campaign in 2014, as a right step, the protesters passed a vote of confidence in the leadership of President Muhammadu Buhari and his anti-corruption war. 
They urged the EFCC to dig deep into the finances of the state and prosecute whoever was indicted in the looting of its treasury. 
APC acting Chairman in the state, Mrs. Kemi Olaleye, said: “We are tired of immunity clause. 
“Immunity has become impunity in Ekiti. We condemn Governor Fayose’s corrupt tendencies. Things must change. 
“The EFCC must do its job and ensure that looters of Ekiti are brought to justice.” 
But Adelusi, countered. He said: “The APC protesters asking Fayose to waive his immunity are doing so out of ignorance and desperation to win the state in 2018 knowing that their aim can only be achieved if Fayose is out of the way. 
“But, it is a failed agenda because we are ever ready for them on daily basis like soldiers guarding entrance of military formation. 
 
“They should know that this is 2016 and not 2006. 
“Their agenda is about 2018 and their game plans are what we are now seeing; using the EFCC to concoct lies and using the media to disparage Governor Fayose, but, they cannot go far. 
“For now, the APC should not be too desperate for Fayose to defend himself against the myriads of allegations. 
“Rather, they should wait till 2018 for the governor to submit himself to the EFCC as he did in 2007. 
“Till now, even the EFCC has not accused Fayose of stealing Ekiti money and if it is concocting one, we shall meet in the court at the appropriate time.”

But they were not. The PDP was the country’s ruling party for 16 years and is in possession of an expansive institutional memory to benefit our democracy. 
 
The PDP, as the country’s leading opposition party, has a formidable structure to help keep the ruling All Progressives Congress (APC) in check. 
 
But, as the APC marked its first anniversary in power, the absence of the opposition was very glaring. Instead of articulating its own informed scorecard of the APC Federal Government at this important milestone, the leaders of the PDP were enmeshed in a complex leadership tussle for the control of its future. 
 
The squabbles saw the leadership fragmented into at least four factions claiming authority at the national level. The factions included those led by Senator Ali Modu Sheriff, who was sacked as the interim national chairman by officials at the recent convention of the party in Port Harcourt, Rivers State. 
 
The second group was led by Senator Ahmed Makarfi, who was appointed as the chairman of a caretaker committee at the convention. A third tendency was the collegiate leadership centered on the founding fathers of the party including Prof. Jerry Gana and Senator Ibrahim Mantu, among others. A fourth group coalesced around the Board of Trustees (BoT) which claimed to have intervened to stop the fragmentation. 
 
The seeming crisis in the PDP is of concern to watchers of our democracy in Nigeria because we need strong alternative political parties to strengthen our multi party system and keep the current party in power on its toes. 
 
The many mistakes that the PDP made as a governing party took place because of the absence of any virile opposition party. We, as a nation, should avoid the mistake of having one dominant ruling party, as this predisposes those in power to impunity and corruption as experience has shown. When this is the case, it is the ordinary people that suffer the misrule more. 
 
We urge both the ruling party and the other political parties to strengthen their internal processes and give their political outfits the character, distinct identity and vision that will give Nigerians real choice when next we go to the polls. 
 
Seventeen years after the military left the political scene, party politics should have grown beyond the mere tussle for power or posts. It should now be more about where each political party wishes to take Nigeria and how they want to achieve it. 
 
This can only happen if our politicians learn from their mistakes and build on areas where they have done well.
